Educated at Hutchins School, Hobart, from 31 January 1881 until Christmas 1883. He then trained as a barrister and solicitor and was admitted to the Bar 19 August 1887. After a few years as solicitor to the the Lands Titles department he went into partnership in 1894 with his father, and the firm was renamed C. H. Elliston & Son. About 1903 he went into partnership with W. M. Hpdgmsn, but after the partnership was dissolved three or four years later he continued alone, until joining Athol Johnston , when the name of the firm became Elliston & Johnston. From 1924 until his retirement in 1932 he carried on his business by himself.

Vivian was keen on sport. He was an active member of the Lindisfarne Golf Club Lindisfarne Cricket Club. Formany years he served on the Clarence Counceil, and was chairman of the Lindisfaren ward. He also held office in the Shiplovers' Society of Tasmania, and during the latter part of his life he became well known as a grower of roses [HUTCHINS REG., NS36; 101, quoted in AOT (Hobart General Index; CYC. TAS. I; 299; The Mercury, 12 October 1934; 12.]
